Court nullifies Embakasi South MP Julius Mawathe’s election

Embakasi South Member of Parliament Julius Mawathe has today lost his seat after a petition that was filled by ODM’s Irshad Sumra.

The court of Appeal cited irregularities in the just concluded August election declaring it not free and fair. 

IEBC declared Mr. Mawathe as the winner after garnering 33,880 votes against Sumra who garnered 33,708 votes. 

Mr. Sumra blamed the IEBC returning officer for the defeat when they “declared the loser as the winner and the winner the loser.” 

Welcoming the news was ODM’s secretary General Edwin Sifuna who was happy about the court decision and hoping that the will of the people shall prevail during the coming by-election. 

“We the @TheODMparty family are elated this morning following annulment of the Embakasi South Parliamentary elections following a successful appeal by Hon. Sumra. We hope that the will of the people shall prevail when the by-election is held.”Sifuna said on Twitter. 

In March Justice Grace Nzioka of the High Court dismissed Mr Sumra’s case saying the petitioner failed to provide sufficient evidence therefore declaring Mawathe as the validly elected Embakasi MP. 

The move prompted Mr. Sumra to move to the second highest court in Kenya to file a petition
