The Deputy Public Prosecutor (DPP) is seeking to have Senator James Orengo from representing KPA manager Daniel Ndambuki.
In his application, the DPP cited a conflict of interest as the major reason why the Siaya Senator should remain out of the case.
Mr. Daniel Ndambuki is moving to court to halt his prosecution following an investigation conducted by the DCI.

Representing the DPP’s office was lawyer Alexander Muteti who said it will be okay for the KPA to be represented by someone who is a state officer.
He continued by saying that even though Senator Orengo is allowed to practice law, his representation will be against the public interest.
As a serving member of the Senate, Orengo is a state officer who is being barred from defending a matter of public interest.
In his defense, the ODM legislator said that the allegations do not prove in any way why he should be barred from representing his client.
Hon. Orengo highlighted that despite being a Senator, he never took part in his selection and thus cannot be barred from practicing law.
