Director of Public Prosecution Noordin Haji has approved prosecution of Busia Governor Sospeter Ojaamong’ and eight others for loss of millions through doggy tenders.
The nine are facing arrest and charges for abuse of office and flouting procurement process.
The other officials are Mr Timon Otieno Mboga, Mr Bernard Krade Yaite, Mr Lenard Wanda Obimbira, Mr Samuel Osieko Ombui,Mr Allan Okweny Omachari,Madam R Enterprises Ltd, Ms Edna Adhiambo Odoyo, Mr Renish Achieng Omullo, and Mr Sebastian Hallensleben.
“Hon Sospeter Ojaamong unilaterally signed a Memorandum of Understanding (MOU) with Madam R Enterprise Ltd (MRE Ltd) in a project of solid waste management system without due regard procedural framework governing management of public finances and projects leading to loss of Sh8 million,” Haji said.
The investigation backdating from 2016 reveals that the tender was single sourced.
Mr Ojaamong’ is alleged to have entered into a Memorandum of Understanding with Madam R Enterprises.
Ethics and Anti-Corruption Commission reveal that two companies were used but they used the same name Madam R,Mada R Limited and Madam R Enterprises.
