Lamu MP loses seat after Court of Appeal rulling

Lamu Senator Anwar Loitipip has today lost his seat following a ruling made by the Court of Appeal.

Hearing the case in Mombasa,Court of Appeal ordered the Independent Electol and Boundaries Commission(IEBC) to conduct a fresh election in Lamu.

The ruling comes after High Court Judge Asenath Ongeri had previously dismissed the petition tabled by Mr. Albeity on grounds of failing to comply with the court timeline. Each party was then ordered to bear their own cost.

 Making the ruling today Judge Alnashir visram, Wanjiru Karanja and Martha Koome cited irregularities in the just concluded Lamu senatorial elections.

Represented by lawyer Yusuf Abuoubakar,Mr. Albeity was a happy man when the Court of Appeal noted that the polls had excess voters than those registered in a poll station.

Mr Albeity and Anwar had a 58 vote difference.
