Magistrate disqualifies himself from Babu Owino’s case

Chief Magistrate Francis Andayi of Milimani Law Court has withdrawn himself from Babu Owino’s case.

The decision by the Magistrate follows a case filed by the prosecution from the office of DPP to the Judicial Service Commission to look into the bail amount.

Embakasi MP Babu Owino was released on Ksh 10 million cash bail which was to be paid in installments.

The payments as explained by Magistrate Francis Andayi were to carter the medical expenses of his victim DJ Evolve.

In his place, Magistrate Benard Ochoi will take over when the case is mentioned on March 2nd.

Currently, the MP faces two charges of an attempt to cause the death of DJ Evolve and carrying a firearm while drunk.

He filed a petition before the court saying that he was unable to pay the bail as he was broke.
