Cabinet Secretary Henry Rotich and PS Kamau Thugge have on Tuesday been released on Ksh 50 Million bonds with an alternative cash bail of 15 million.
The two Treasury bosses were arrested alongside 26 other over the Arror-Kimwarer dam scandals that saw Ksh 19 billion issued contrary to procurement laws.
Passing the verdict Magistrate Douglas Ogoti bared the two from accessing their offices terming them as the scene of the crime.
He continued by saying that under circumstance they want to access their officers, they will do so under the vigilance of an investigative officer.
Magistrate Ogoti also ordered the two to deposit their passports with the court in the next 48 hours.
The Treasury CS was arrested following an arrest warrant issued by DPP Noordin Hajji on Monday.
His arrest followed next as he surrendered at the Directorate of Criminal Investigation on the same day.
All the accused parties in the Arror-Kimwarer dam scandal have been accused of failing to comply with the applicable laws governing the procurement process.
In addition to that, they have been accused of abuse of office and negligence to perform their duties.
The case is set for hearing on August 8th
