The two who are also directors of Erad Supplies and General Contracts Limited were sourced to supply 40,000 tonnes of relief food and even pocketed the said amount but failed to do so.
It was later established that they did not have the resources to supply the maize before the contract was pulled out by NCPB.
Erad moved to court claiming they had already spent US Dollar 1 million to store the maize with a South African firm by the name Chelsea Freight.
They won the case after it was established that they indeed run into losses and that they were supposed to be compesated.
NCPB lost its battle to block the payment leading to the company assets being attached to pay off Ksh 313 million.
Investigations led EACC to sought answers in South Africa where they visited Chelsea Freight only to learn they never transacted with them.
In addition to that, EACC also learnt that the documents forwarded by Erad to as proof of transaction had been forged.
