The High Court has halted prosecution of senior NEMA officials charged with the deadly Embakasi gas explosion saying that they enjoy statutory immunity.
The February 2024 incident occurred inside an illegal gas station killing 12 people and injuring several others in the process.
- Two male suspects rape and strangle to death 29-year-old woman in Embakasi
- Embakasi gas plant owner and three NEMA officials arrested
- Ruto orders arrest of gov’t officials who licensed Embakasi gas company
Also affected during the massive explosion was the destruction of nearby homes and businesses located at the densely populated area.
Investigation into the incident revealed that the plant was not only operating illegally but had also been issued with safety approvals which were all illegal.
What followed next was the arrest of senior National Environment Management Authority (NEMA) who have since challenged their detention calling for a written justification.
The DPP pleaded with the court to allow the individuals charged with the crime, a request that was challenged by the court on the grounds of who will carter for the legal cost and whether they enjoy immunity.
The High Court continued by saying that they enjoy immunity and that they were within their legal mandate which they cannot be held accountable to.
