AG and CAK seek court to lift suspension on Cybercrime laws

The Attorney General (AG) and the Communications Authority of Kenya (CAK) have moved to court seeking the suspension of sections of the Computer Misuse and Cybercrimes Act.

Appearing before High Court Judge Justice Lawrence Mugambi, the lawyers representing the two agencies noted that the suspension should be lifted as interim orders were issued in the absence of the affected parties.

They continued by informing the court that the petitioners had failed to issue them with their submissions as directed by the court.

“We have no doubt that when the orders were issued, the court took into account that they were made ex parte and directed the petitioners to serve the respondents with the application and submissions. However, they did not comply with that order,” said the AG office.

“I urge that before hearing the application on consolidation, the court should first hear our application for stay and determine it,” they continued

The laws have been challenged by six petitioners who claim that they infringe constitutional rights, including freedom of expression and privacy.

Justice Mugambi directed that the matters brought forward should be consolidated and presented before the court tomorrow, before further directions are issued.
